We specialize in Mutant and Superhero Law and I am afraid that your interpretation of the MCO mandate is incorrect in this instance. Whateley grounds are designated neutral ground since it falls under tribal law rather than being under state or federal jurisdiction."
|
| OK, looks like in the Whateley universe, Tribal sovereignty is different to this one. From Wikipedia| Quote: | Congress can, however, limit tribal sovereignty. Unless a treaty or federal statute removes a power, however, the tribe is assumed to possess it. ... However, most Indian land is held in trust by the United States, and federal law still regulates the political and economic rights of tribal governments. Tribal jurisdiction over persons and things within tribal borders are often at issue. While tribal criminal jurisdiction over Indians is reasonably well settled, Tribes are still striving to achieve criminal jurisdiction over non-Indian persons who commit crimes in Indian Country.
|
Emphasis mine. Summary (mine) In this universe:
1. Tribes are not subject to state or county law.
2. Tribes are subject to federal law.
3. Status of Non-Indians on tribal land is unclear. (Federal can always claim jurisdiction. State and County may be able to as well.)
Mathematics is the language that commands the universe. Science is how you learn it. Engineering is how you speak it.

Here:
| There's An Angel In Father John's Basement | Cued by a hint given her by Natalie, via her earpiece, Suki cut them off. "I'm sorry, but that can't be right -- the MCO charter clearly spells out that the Office MUST carry out detentions and questionings in accordance with the Laws and Procedures of the country that they are operating in. By US Law, you MUST have Due Cause to detain that person."
"Yes, but by the provisions of the Patriot Act-"
"which does NOT include the MCO."
"Look, Miss, you are obstructing duly designated law enforcement officers in the performance of their duty-"
"SO, you DO have a warrant?"

| Is it too far-fetched to think that it could be otherwise with Miscatonic Valley in Whateleyverse?
|
I believe that the Iroquois Five Nations land (Mohawk and other related tribes) is NOT held in trust - because the reservation crosses over into Quebec. It's almost a hole in the border between Canada and the US.

Note, also, that there's a simple explanation...Carson was pulling out stuff that wouldn't stand in court, but WOULD scare the pants off the MCO, since they don't want to fight with Carson. At least, not right now.
And, don't forget that this is not just ANY 'tribe', it's a bunch of freaking were-creatures that rip people's arms off.

"First message, M-SOC Naval, whoever is in command, Warning Alert, code Bravo-Seven-Hijacker. Delta Sierra, SOC. The MCO is issuing DFA's to minor citizens of the USA, Whateley Academy students have been targeted, very likely others as well. Butcher's Row is starting again."
| (emph. mine)
Anyone know what Butcher's Row represents? This doesn't ring any bells for me offhand...
| By implication, it sounds like the Dragonslayers had a 'Marked for Death' list...
Odds are, someone is assembling a new list, since the reference seems to tie directly to the DFA's on the MID's
| I don't think it was the Dragonslayers' list. I think MCO has tried pulling this kind of crap before.| Call the Thunder 6 |
Caitlin looked at the mixed bag of about seven students waiting in the woodworks to talk to the MCO. None of them looked thrilled to be there, and she saw at least three frightened looks. She sighed, suppressing feelings of hatred as she saw the three dark-suited agents of the Mutant Commission Office. It wouldn't help her cause to show outright hostility and anger. Dollars to donuts, the agents present were unaware of the existence of Butcher's Row.
| It sounds from these two quotes like MCO has had a program for eliminating potentially dangerous mutants activated before, and now htey're activating the same program again.
Pearson is a mutant leading a mutant-rich branch of the military, it's likely she personally or M-SOC (in whole or in parts) were targets the first time, or had relations with the targets last time.

My big question is this:
| Quote: | Caitlin pulled out a piece of paper and unfolded it carefully. The paper was blank, but she wanted to make it look like she was an actual messenger. "First message, M-SOC Naval, whoever is in command, Warning Alert, code Bravo-Seven-Hijacker. Delta Sierra, SOC. Top of my head, sounds like The Final Solution to the mutant problem of all those kids that the MCO managed to "disappear".
Any sufficiently unethical experiment is indistinguishable from Hell.
